MH370: Malaysia Airlines ‘negligent’ in death of Victorian man onboard, wife says in court filing

A Victorian woman who lost her husband when flight MH370 crashed two years ago is suing Malaysia Airlines.

In a writ lodged with the Victorian Supreme Court, Yen Li Chong, 49, alleged the airline breached its duty of care, resulting in the death of her husband, Chong Ling Tan, a business class passenger on the flight, which disappeared in March 2014.

Ms Chong alleged the airline was negligent and failed to ensure the flight was safe, monitored and tracked at all times.

It was also alleged Malaysia Airlines failed to ensure reasonable or adequate safety precautions were taken, and failed to ensure its crew, servants and agents followed all proper procedures and did not commit any wrongful acts.

The writ alleged that had the airline ensured the flight was safe, that there were adequate safety precautions, and that the flight was supervised, it would not have disappeared.

Ms Chong, who is joined in the action by her two sons, aged 19 and 14, is suing the airline for unspecified damages, claiming nervous shock and loss of earnings.

The plane veered off course on a flight between Kuala Lumpur and Beijing on March 8, 2014.

Boeing 777 debris found on the island of La Reunion, confirmed to be from the flight, proves it crashed in the Indian Ocean.

However, the cause of the disaster remains unknown.
